Terms of Service

1. Acceptance of Terms

By accessing or using FlashOps AI Phone ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Service Description

FlashOps AI Phone provides an AI-powered phone answering service for businesses. The Service includes a dedicated phone number, AI call handling, call transcription, lead capture, and a management dashboard.

3. Account Registration

To use the Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Be responsible for all activities under your account
  • Notify us immediately of any unauthorized use

4. Billing and Payment

  • Free Trial: New accounts receive a 14-day free trial with full plan features
  • Subscription: After the trial, you will be charged monthly based on your selected plan
  • Included Minutes: Each plan includes a set number of AI call minutes per month
  • Overage: Usage beyond included minutes is billed at $0.25 per minute
  • Cancellation: You may cancel your subscription at any time. Access continues until the end of your billing period
  • Refunds: Subscription fees are non-refundable except where required by law

5. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Conduct fraudulent, deceptive, or illegal activities
  • Harass, abuse, or harm others
  • Send spam, unsolicited messages, or robocalls
  • Impersonate others or misrepresent your business
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to systems
  • Use the Service for any purpose other than legitimate business communications

6. AI Limitations

You acknowledge that:

  • The AI may occasionally misunderstand or provide inaccurate responses
  • The AI cannot make commitments, guarantees, or legal agreements on your behalf
  • You are responsible for reviewing leads and call summaries for accuracy
  • The Service is not a substitute for professional advice (legal, medical, financial, etc.)
  • Call transcription may contain errors, especially with poor audio quality

7. Phone Number

  • Phone numbers are provisioned for your use during your active subscription
  • You do not own the phone number; it is licensed to you
  • Upon cancellation, your phone number may be released after 30 days
  • You can forward your existing business number to your FlashOps AI number

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for obtaining any necessary consents from callers regarding call recording and data collection, as required by applicable laws.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We are not liable for any damages resulting from service interruptions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLASHOPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless FlashOps, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Johnson County, Kansas.
